Basic Terms

4. You may not use ClubPond.com for any illegal or unauthorised purpose. International users are free to comply with all local laws regarding online conduct and acceptable content.
5. You must not modify, adapt or hack ClubPond.com or modify any website so as to falsely imply that it is associated with ClubPond.com
6. You are solely responsible for you content and any data, text information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post and display on the ClubPond.com service.
7. You must not, in the use of ClubPond.com, violate any laws in your jurisdiction (including but not limited to copyright laws).
8. You must not create or submit unwanted email to any ClubPond.com members ("Spam").
9. You must be thirteen (13) years of age or older to use the ClubPond.com service.

By using ClubPond.com, you represent and warrant that you are thirteen (13) or older and in high school or college, if under eighteen (18) years old, or else you are eighteen (18) or older, and that you agree to and abide by all of the terms and conditions in this Agreement.

General Conditions

1. We reserve the right to modify or terminate the ClubPond.com service for any reason, without notice at any time.
2. We reserve the right to alter this Agreement ("Terms of User") at any time. If the alterations constitute a material change to the Agreement, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and judgement.
3. We reserve the right to refuse service to anyone for any reason at any time.
4. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any parties intellectual property or these Terms of Use.
5. We reserve the right to reclaim username on behalf of business or individuals that hold a legal claim or trademark to those usernames.
6. You will not take legal action against ClubPond.com or any third party involved in ClubPond.com for any reason.

Advertising

1. We may use your ClubPond.com Account details to better display advertisement in your area or field.
2. We reserve the right to display any advertisements on any ClubPond.com Account.
3. Our best efforts will be made to match advertisements to your ClubPond.com Account. However if no advertisement is found we will display a generic advertisement.

Copyright

1. We encourage users to contribute their Content to the public domain, however we claim no intellectual property rights over the Content you provide to the ClubPond.com service. You profile and Content uploaded remain yours. You can remove your profile at any time by requesting your account be deleted. This will also remove any Content you have stored in the System.
2. ClubPond.com obeys all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim please contact us.
3. If there is a Copyright infringement ClubPond.com will remove the content immediately, after seeking legal advice. You do no have grounds for any further legal action.
